Type of evidence: Sworn factual statement (constat d’huissier) by a French judicial officer (huissier de justice)
Appointed by the French Ministry of Justice, a huissier de justice is a State-authorized legal enforcement officer with exclusive powers to serve legal documents, enforce court rulings, and certify factual observations.
In particular, a huissier de justice can produce what is known in French law as a constat d’huissier — a formal written report that objectively records and certifies the existence of facts at a specific time and place. This might include, for example, the condition of a building, abusive online posts, noise disturbances, or the content of a website. These reports are legally recognized and carry strong evidentiary weight in court, often helping to prevent or resolve disputes before litigation arises.

Monopoly ORIGINAL 2011 GAME at McDONALD’S™
COMPLETE RULES OF THE GAME, DRAWN UP AS AT 14 SEPTEMBER 2011
ARTICLE 1
The GIE McDONALD’S FORCE — groupement d’intérêt économique (French: an “economic interest grouping”, a French legal form allowing separate companies to pool resources in a joint entity) — whose registered office is located at 1, rue Gustave Eiffel 78045 Guyancourt Cedex, and the restaurants trading under the McDonald’s sign in metropolitan France and Monaco (hereinafter “the organising companies”), are organising a major free game with no purchase obligation entitled « Monopoly Original » from 19 October 2011 to 15 November 2011 inclusive.
The duration of the game may exceptionally be extended by a maximum of 7 days, i.e. until 22 November 2011. In the event that the Game Pieces, as defined below, are exhausted before 15 November 2011 in one or more of the restaurants, the ending of the game in the restaurant(s) concerned will be announced there.
The game is open to residents of metropolitan France and of Monaco aged 13 and over as at 19 October 2011, excluding persons who are members or employees of the organising companies (GIE McDonald’s Force, the staff of the restaurants trading under the McDonald’s sign) and, more generally, of any company belonging to the McDonald’s France Group; persons who are members or employees of the companies holding the rights (Groupe Hasbro France, Hasbro Consumer Products); persons who are members or employees of the companies, whether independent or not, acting as service providers for this operation (in particular The Marketing Store, Tessi, TBWA\PARIS, Being, SEDA, LRServices, Havi Global Solution, WS, DDB Paris, etc.); persons who are members or employees of the companies partnering the operation; as well as their families (spouses, ascendants, descendants, brothers and sisters).
To take part, it is sufficient to obtain one or more « Monopoly Original » Game Piece(s). A Game Piece means the item consisting of a self-adhesive double game stamp (also otherwise called a double card) (two (2) game stamps), which may only be obtained under the conditions described in Article 2 below.
ARTICLE 2 — HOW TO OBTAIN A GAME PIECE

EITHER FREE OF CHARGE ON SIMPLE WRITTEN REQUEST BETWEEN 19/10/11 AND 05/11/11 INCLUSIVE (THE POSTMARK BEING AUTHORITATIVE), ON PLAIN PAPER, STATING VERY LEGIBLY ONE’S SURNAME, FIRST NAME AND FULL ADDRESS, TO THE FOLLOWING ADDRESS: JEU McDONALD’S MONOPOLY ORIGINAL - CEDEX 3079 - 99307 PARIS CONCOURS.
Only one Game Piece will be sent per request, and a maximum of 2 requests per person will be honoured for the entire duration of the game. Postage costs will be reimbursed at the tarif lent (French: the “slow rate”, the economy postal rate) in force, upon a simple concurrent request. Any request made by any other means (fax, telephone or electronic mail, etc.) will be refused.

Or by purchasing a medium non-alcoholic fountain drink (40cl), on the packaging of which a Game Piece (one double sticker) is affixed, or a large non-alcoholic fountain drink (50cl), on the packaging of which two Game Pieces (two double stickers) are affixed.
These products may be purchased separately or included in the purchase of a Menu Best Of™ for the medium fountain drink (40cl) or of a Menu Maxi Best Of™ for the large fountain drink (50cl).
For the medium drink or the large drink chosen as part of the purchase of a Menu Best Of™ or of a Menu Maxi Best Of™, and solely for the drink chosen as part of one of those menus, if that drink is a non-fountain drink (Evian, Badoit, beer, Minute Maid Orange), the Game Piece corresponding to the purchase of that drink will be handed over in person to the participant, i.e. one Game Piece for a medium drink served as part of a Menu Best Of™ and two Game Pieces for a large drink served as part of a Menu Maxi Best Of™.

Or by purchasing a McFlurry™, or a hot drink (20cl) or a small hot drink (10cl), on the packaging of which a Game Piece is affixed.
ARTICLE 3 — HOW TO PLAY
The Game Piece must be carefully detached from the packaging of the non-alcoholic fountain drink, from the packaging of the McFlurry™, from the packaging of the hot drink, from the carrier handed over in person to the participant in the restaurant under the conditions referred to above, or from the carrier supplied free of charge on simple written request, by pulling it downwards and following the perforations illustrated.
The participant may:
3.1. Either hold a game stamp bearing the wording « GAIN » (French for “WIN” / “winnings”) and a symbol representing one of the prizes described in Articles 4.1. and 4.3. below:
If, after detaching the Game Piece, a participant discovers that one and/or the other of the game stamps bears the wording « GAIN » and a symbol representing one of the prizes to be won immediately as described in Articles 4.1. and 4.3., he wins that prize, subject to verification of the validity of his game stamp and of its compliance with these game rules.
3.2. Or hold a game stamp bearing a street name or a station name and collect them in order to try to win one of the prizes described in Article 4.1. below:
If, after detaching the Game Piece, the participant discovers that one and/or the other of the game stamps is a game stamp bearing a street name or a station name and a code ending in the letter « M » preceded by a 3-digit number, he must keep it in order to try to reconstitute the complete « family » of the series concerned, namely the various game stamps of one and the same colour, each bearing a different street name and number, or the series of the various « Gares » (French: railway stations), likewise each bearing a different name and number.
As soon as he has completed one of the 8 families of title deeds or the « Gares » series, the participant wins the prize corresponding to the family collected (see Article 4.1.), subject to verification of the validity of the game stamps and of compliance with these game rules.
The game stamps intended to be collected under the conditions set out in this Article must be peeled off their backing carefully so as to expose the adhesive face, and may be stuck onto the game board in the corresponding position.
The game board (in the form of a leaflet or of a tray mat) enabling the collected game stamps to be gathered together will be made available to participants in all the restaurants trading under the McDonald’s sign in metropolitan France and Monaco, either by the staff at the counter or on a self-service basis, from 19 October 2011 to 15 November 2011 inclusive, and this within the limit of available stocks. The game board will also be downloadable from the website www.mcdonalds.fr, from 19 October 2011 to 15 November 2011 inclusive.
Participants are not, however, obliged to use this carrier, which is optional. They may also stick their collected game stamps onto plain paper.
3.3. Or hold a « CARTE CHANCE » game stamp (French for “Chance card”), bearing the wording « CHANCE » and a code, in order to try to win one of the 10 000 € prizes described in Article 4.2. below:
If, after detaching the Game Piece, the participant discovers that one and/or the other of the game stamps bears the wording « CHANCE » and a code, he must keep it and then follow the instructions below:
- log on to the website www.mcdonalds.fr or to the McDonald’s mobile site before 17:59:59 between 19 October 2011 and 14 November 2011, and before 23:59:59 on 15 November 2011.
- click on the link « tentez de gagner 10 000 € » (French for “try to win 10 000 €”) and follow the instructions in order to register and take part.
Warning: The participant must carefully complete the online registration form that will be offered to him in order to create his account. The organising companies reserve the right to set aside, disqualify or invalidate the winnings of any person failing to comply with the provisions of these rules, in particular if the information and contact details supplied by the participant are invalid, erroneous or incomplete.
At the time of his online registration, the participant may, at his choice, either upload a photograph representing himself from his Facebook profile in compliance with the terms and conditions of these game rules, or use one of the avatars that will be offered to him in order to illustrate his account.
The participant expressly authorises the organising companies to use his surname (or its initial) and/or first name and/or the name of the département (French: the administrative district) of his place of residence and/or the photograph uploaded or the avatar he has chosen, in order to illustrate his account on the mcdonalds.fr site and on the McDonald’s mobile site on the one hand, and within the framework of the animated features that will be produced and broadcast on the website www.youtube.com/monopolymcdonalds in order to reveal the results of the prize draws on the other hand, as referred to in Article 4.2. of these rules. This authorisation is given by the participant for a period of 24 months from the start date of the operation, i.e. 19 October 2011.
For its integration into the aforementioned animated feature, the participant’s photograph may be subject to modifications or alterations on account of the technical requirements relating to the conditions under which the photographs are broadcast, which the participant acknowledges and accepts. The liability of the organising companies may not under any circumstances be invoked in this respect.
If the participant chooses to upload a photograph from his Facebook profile, he undertakes that it shall be an original creation, shall depict only his own person and shall not include any text. The participant further declares that he holds all of the intellectual property rights attaching to that photograph and to all of the elements of which it is composed. The participant declares that his photograph, including all of the elements of which it is composed, is original, and that they infringe no third-party right and/or author’s right.
Thus, without the following being limitative, the participant declares that his photograph and all of the elements of which it is composed or which are associated with it are in no way unlawful in character, do not contravene any French statutory provision in force, and contain in particular no element infringing the intellectual property rights of a third party, nor any pornographic, paedophilic, shocking, violent, coarse element, or element offensive to human dignity, insulting or defamatory towards others, or aimed at harassing or threatening other persons, condoning crimes against humanity, inciting hatred, discrimination or violence towards a person or a group by reason of their race, their nationality, their ethnic origin, their religion, their sex, their sexual preferences, their disabilities or any other difference, and/or whose content might damage the image and/or the credibility of the organising companies.
The participant guarantees to the organising companies the peaceful and exclusive exercise of the property right which he assigns to them under these rules and undertakes to have it respected and to defend it against any infringements that may be committed against it. The participant undertakes to indemnify the organising companies for any loss that may result from the use of his photograph and in particular to reimburse the organising companies for all damages and costs that the latter might bear or have to incur in this respect.
The participant, if he is a minor, undertakes to have obtained the prior agreement of a legal representative before uploading his photograph. Where applicable, the participant undertakes to provide the organising companies, on simple request, with the written parental authorisation that he will have obtained prior to his registration.
In any event, the organising companies reserve the right, at any time, to delete the photograph of a participant which they consider to be contrary to these rules. In that case, the organising companies have the option, at their entire discretion, of disqualifying the participant from the prize draw or of replacing his photograph with an avatar of their choice without his agreement, in order to allow him to take part in the prize draw.
After confirming his registration and entering his code, the participant will immediately receive a message informing him that he is entered in the prize draw for the day of his participation if he entered his code before the deadline indicated above, or in the prize draw for the day following his participation in the case of a code entered from 18:00 onwards, or in the prize draw of 15 November 2011, which will be carried out on 16 November 2011 among the codes entered between 14 November at 18:00 and 15 November at 23:59:59.
Each code affixed to the « CARTE CHANCE » game stamps is for single use only and will therefore allow only one participation.
ARTICLE 4 — PRIZES OFFERED
The prizes offered are as follows:
4.1. The prizes awarded by the « Monopoly Original » Verification Centre:

2 prizes of 100 000 € paid by bank transfer to be won: one with the game stamp bearing the wordings « GAIN » and « 100.000 € », and the other by collection, by reconstituting the « family » of stickers of the dark blue series: « AVENUE DES CHAMPS-ELYSÉES » bearing the code « 221M » and « RUE DE LA PAIX » bearing the code « 222M ».

10 MINI COOPER 122 Ch (French chevaux, i.e. horsepower — 122 hp) vehicles with a unit commercial value of 19 830 € T.T.C. (French toutes taxes comprises, i.e. inclusive of all taxes) (price as at 01/08/11) to be won.
5 vehicles to be won with the game stamps bearing the wordings « GAIN » and « 1 VOITURE » (French for “1 CAR”), and 5 further vehicles to be won by collection, by reconstituting the « family » of stickers of the green series: « AVENUE DE BRETEUIL » bearing the code « 218M », « AVENUE FOCH » bearing the code « 219M » and « BOULEVARD DES CAPUCINES » bearing the code « 220M ». These prizes include the vehicle commissioning costs and do not include the registration costs (carte grise, French: the vehicle registration document), nor the insurance costs, nor the transport costs between the winner’s home and the location of the dealership, which remain payable by the winner. Each winner will take possession of the vehicle from the dealer / reseller designated by the partner Mini within a period of 6 months from the date on which the win is confirmed to the winner.

20 prizes each consisting of a « VOYAGE » (French for “TRIP” / “TRAVEL”) with a unit amount of 9 000 € T.T.C., usable with the partner travel agency (whose contact details will be sent to the winner when his prize is awarded) and to be set against the purchase of travel. The amount of this trip may be used in one or more instalments and until 19 October 2012 inclusive. The winner may use this travel amount for himself as well as for any person of his choice who accompanies him on his trip(s) (including any member of his family), up to the limit of the amount of 9 000 €. If, as at 20 October 2012, the whole of the amount has not been used by the winner, the remaining credit will be lost. Furthermore, in the event that the winner refuses the letter confirming the win which will be sent to him by registered post with acknowledgement of receipt, the win will be lost.
10 trips to be won with the game stamps bearing the wordings « GAIN » and « 1 VOYAGE », and 10 further trips to be won by collection, by reconstituting the « family » of game stamps of the yellow series: « FAUBOURG SAINT-HONORÉ » bearing the code « 215M », « PLACE DE LA BOURSE » bearing the code « 216M » and « RUE LA FAYETTE » bearing the code « 217M ». Like all the other prizes, this prize is non-transferable, non-assignable, non-modifiable and non-refundable.

4.2. The 10 000 € prizes offered on the Internet and awarded by the « Monopoly Original » Verification Centre.
The organising companies are offering 28 prizes of 10 000 € to be won, at the rate of one prize offered each day. This prize will be awarded each day by a draw among all the participants who have registered and entered a code from the « carte chance » sticker on www.mcdonalds.fr or on the McDonald’s mobile site before 17:59:59 between 19 October 2011 and 14 November 2011, and between 18:00 on 14 November 2011 and 23:59:59 on 15 November 2011. Between 19 October 2011 and 14 November 2011, the draw will be carried out each day at 18:45 and will be revealed each day in the form of an animated feature at 19:45 on the website www.youtube.com/monopolymcdonalds. The draw of 15 November 2011 will take place at 10:00 on 16 November 2011 and the winner will be revealed on 16 November at 11:45 in the form of an animated feature on the website www.youtube.com/monopolymcdonalds.
Only participants in possession of « CARTE CHANCE » game stamps, as described in Article 3.3. above, will be able to try to win one of these prizes, by completing the registration form and by entering, between the dates and times indicated above, the code reproduced on the said « CARTE CHANCE » game stamp in the space provided for that purpose on the website www.mcdonalds.fr or on the McDonald’s mobile site.

ARTICLE 5 — SUBMISSION OF GAME STAMPS AND AWARDING OF PRIZES
The awarding of each prize will be carried out after verification, by the « Monopoly Original » Verification Centre, of compliance with the rules of the game contained in these rules for the prizes referred to in Article 4.1., and by the restaurants for the prizes referred to in Article 4.3. above (with the exception of the music tracks). The 10 000 € prizes referred to in Article 4.2. of these rules and the music tracks mentioned in Article 4.3. will be awarded under the conditions and in the manner detailed in Articles 5.3. and 5.4. below.
The « Monopoly Original » Verification Centre and the restaurants will verify, each as regards the prizes that concern them, the authenticity and the validity of the game stamps, and will in particular refuse any game stamp that has been falsified, crossed out, damaged, photocopied or that appears suspicious and/or abnormal.

- Either go to www.mcdonalds.fr to download, complete and print the game stamp submission form,
- Or copy out the game stamp submission form on plain paper,
- Or make a written request to the game address set out in Article 2 of these rules by 15 November 2011 at the latest (the postmark being authoritative), stating on plain paper the wording « demande de formulaire pour obtenir ma dotation » (French for “request for a form to obtain my prize”), together with his contact details (Surname, first name, postal address).
He must then follow the procedure described below:
- ensure that he has properly stuck it/them onto the corresponding square of the game board (or onto plain paper).

ARTICLE 10 — REIMBURSEMENT OF THE VARIOUS PARTICIPATION COSTS
The organising companies undertake to reimburse by transfer, to any participant who so requests, the costs incurred in order to take part and/or in order to submit his game stamp(s) and/or in order to obtain a copy of these rules, and this under the following conditions:
10.1. Reimbursement of stamps (at the tarif lent 20 g rate in force), on concurrent request accompanied by a RIB or a RIP (French: Relevé d’Identité Bancaire — bank account identification statement; Relevé d’Identité Postal — postal account identification statement):
- for the written requests for a Game Piece in accordance with Article 2 of these rules.
